When processing your personal data, I proceed in a lawful manner, in accordance with applicable legislation, with the Personal Data Protection Act and EU Regulation 2016/679 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data.

We process your personal data in accordance with the requirements of the GDPR, Act No. 18/2018 Coll. on the protection of personal data and on amendments and supplements to certain acts, as amended, and other generally binding legal regulations.

Recipients or categories of recipients to whom the data may be made available/notified:

Public authorities, health insurance companies and others in the event of the existence of relevant legal regulations, external suppliers in accordance with §11 BDSG, external service providers, affiliated companies and internal departments for the purpose specified in point 5.

4. SOURCES AND CATEGORIES OF PROCESSED PERSONAL DATA

 

The operator processes the personal data that you have provided to him/her or the personal data that the operator has obtained based on the fulfillment of your order.

The operator processes your identification and contact data and data necessary for the fulfillment of the contract.

 

The Operator is entitled to process in particular the following personal data of the Data Subject:

• address and identification data serving for the unambiguous and unmistakable identification of the Data Subject (e.g. name, surname, title, permanent address, business address, delivery address, company ID, VAT number) and contact data with the Data Subject (e.g. contact address, telephone number, e-mail address, etc.),
• descriptive data (e.g. bank details, order history),
• photos, thumbnails, banners and videos,
• data provided beyond the scope of applicable laws processed within the framework of the consent granted by the Data Subject (e.g. use of personal data for the purpose of personnel management, use of personal data for the purpose of promotion, etc.),
• personal settings (preferences), including marketing settings and the use of cookies by the Data Subject,
• other data necessary for the performance of the contract,
• other personal data that the Data Subject provided to the Operator.

 

5. PURPOSES OF PROCESSING PERSONAL DATA

The Controller processes the personal data of the Data Subject for the purposes of:

1. performance of the contract, based on Art. 6 para. 1 letter b) GDPR,
2. compliance with the legal obligation of the Operator set out in generally binding legal regulations, namely on the basis of Art. 6 para. 1 letter c) GDPR (e.g. the Operator's obligation to keep accounting and tax documents),
3. determination, exercise or defense of legal claims of the Operator, based on Art. 6 para. 1 letter f) GDPR,
4. sending commercial communications, based on Art. 6 para. 1 letter f) GDPR due to the existence of the Operator's legitimate interest in direct marketing,
5. other marketing purposes of the Operator associated with the offer of products and services; sending information about news (products, technologies, showrooms), company presentations (fairs, exhibitions), services, etc. (e.g. in the form of sending newsletters, telemarketing); contacting for the purpose of market research and marketing surveys; contacting for the purpose of greetings on important public holidays and sending gift vouchers, etc., based on Art. 6 para. 1 letter a) GDPR.

 

6. PERIOD OF PERSONAL DATA STORAGE

IusHub, s.r.o. will destroy the stored data after the period specified by law, the consent granted or if it no longer needs it. Personal data will only be processed for the period required

 

• for the purpose according to letter A) above, personal data will be processed until the termination of the obligations under the contract (this does not affect the possibility of the Operator to subsequently process these personal data further - to the necessary extent),
• for the purpose according to letters B), C), D) and/or E) above,
• for the purpose according to letter B) above, personal data will be processed for the duration of the relevant legal obligations of the Operator,
• for the purpose under letter C) above, personal data will be processed until the 4th calendar year following the end of the warranty period under the contract (if a quality guarantee was agreed in the contract), but at least until the 5th calendar year following the termination of the obligations under the contract,
• in the event of the initiation and duration of judicial, administrative or other proceedings in which the rights or obligations of the Operator in relation to the relevant Data Subject are resolved, the period of processing of personal data shall not end
• for the purpose under letter C) above before the end of such proceedings,
• for the purpose of sending commercial communications pursuant to letter D) above, personal data will be processed until the Data Subject expresses his/her objection to such processing,
• for the purposes under letter E) above, personal data will be processed for the period for which the Data Subject has granted the Controller consent pursuant to the separately agreed consent to the processing of personal data. In this case, the Data Subject acknowledges that the Controller may contact him/her before the expiry of this period in order to renew his/her consent.

• the right to access your personal data pursuant to Section 21 of the Act,
• the right to correct personal data pursuant to Section 22 of the Act, or to restrict processing pursuant to Section 24 of the Act,
• the right to erasure of personal data pursuant to Section 23 of the Act,
• the right to object to processing pursuant to Section 27 of the Act,
• the right to data portability pursuant to Section 26 of the Act,
• the right to withdraw consent to processing in writing or electronically to the address or email of the Operator.

2. Furthermore, you have the right to file a complaint with the Office for Personal Data Protection if you believe that your right to personal data protection has been violated.

These rules apply to Data Subjects, unless otherwise agreed between a third party and the Operator. The Operator reserves the right to change these terms and conditions for the protection and processing of personal data in any way and at any time, while the current status will always be posted on the iushub.sk website.
